This applies in particular to events where stagehands are employed through temporary work agencies. In such cases, the stagehand is regarded as a 100%iger employee of the organiser.
Thus, the responsibility for the implementation of the Workplace Ordinance (ArbStättV) and the Industrial Safety Ordinance (BetrSichV) lies with the organiser.
The setup and dismantling phase of an event is legally considered construction work and is therefore subject to the construction site regulations. According to §3 of the Construction Site Ordinance, the organiser is obliged to appoint a coordinator for safety and health protection.
